العباءة الشرعية هي التي جاء ذكرها في ما رواه البخاري في صحيحه .
أن النساء في عهد النبي صلى الله عليه وسلم كن ينصرفن من صلاة الفجر وهن متلفعات بمروطهن أي متجللات بحيث أنه يسقط الخمار من أعلى الرأس فيجلل البدن من جميع جنباته فلا يتبين منه عضو كالعباءة التي تكون في نجد في القصيم بخلاف ما أُحدِث في جدة من وضع النساء بعضهن العباءة على الكتف ثم أنها تربط على رأسها أو على جمجمتها فتجمع بين خطأين:
الخطأ الأول : تحجم حجم رأسها وهو عورة
الخطأ الثاني: أن تحجم حجم كتفيها وهو عورة.
فينبغي أن تلتزم نصيحة النبي صلى الله عليه وسلم بقوله إني أخاف أن يحجم عظمها وهذا عظم الكتفين ، نعم. او كما قال صلى الله عليه وسلم.
ولا تبين حتى الحذاء، قال الإمام أحمد : تسقط -يعني- جلبابها عليها حتى لا يظهر حذاءها لأن حذاءها على قدر رجلها فيكون تحجيم للعظم -لعظم رجلها.
وقد قال النبي صلى الله عليه وسلم : ".. يرخينه ذراعًا ولا يزدن.."

So regarding to this question the Sheikh said that the women should wear the 'abayah that is legislated, and he said that this had been clarified by the hadeeth that we find in Al-Bukhari. The women were described -on the time of the Prophet salla Allah 'aleyhi wa sallam- that they left the Fajer prayer wearing their overgarments, and they came from their heads all the way down to the floor. And you wouldn't see a bone; you wouldn't see a bone of her body- i.e the shape of the bone sticking out. It was not tight-that's the meaning. So the Sheikh said that it is like what we see in the 'abayah that it is worn in Qaseem and not that what's worn by some people in Jeddah and other places in the Arab world. The Sheikh added we see a mistake that some of the women wear their shoulder 'abayah which is obviously exposing the shape of her shoulders.
المترجم : المخالفة الثانية يا شيخ؟
الشيخ ماهر: تقصير العباية حتى يبان شكل حذاءها. الحذاء يأخذ شكل القدم ، يكون محجم لشكل القدم.
The Translator : The second mistake that she makes when she wears the shoulder 'abayah when she wraps something around her head. She's also showing for example the shape there. So the Sheikh said rather I advice the sisters to stick to the over garments that has been legislated and to worry about Prophet -salla Allah 'aleyhi wa sallam's words when he said I fear that they would expose their bones(meaning their shapes) or as Prophet Muhammad -salla Allah 'aleyhi wa sallam said. He said to the extent that Imam Ahmad -rahimah Allah- said that the shoes of the women shouldn't be exposed. Prophet -salla Allah 'aleyhi wa sallam said ‘‘ zira' ’’ an arm stand of the women's garment should come below on the floor.
Slight modification had done to the translation which won't affect the meaning in sha' Allah
